Pro Hac Vice Certification

Overview

A person admitted to practice in another state, but not in this state, shall be permitted to practice a case in this state only if that attorney subjects himself or herself to the jurisdiction and rules of the Supreme Court of Kentucky, pays a per case fee equal to the annual dues paid by those KBA members who have been admitted to practice law for five years or more to the Kentucky Bar Association and engages a member of the association as co-counsel, whose presence shall be necessary at all trials and at other times when required by the court. No motion for permission to practice in any state court in this jurisdiction shall be granted without submission to the admitting court of a certification from the Kentucky Bar Association of receipt of this fee.

Certification Process

1. Complete the Pro Hac Vice Certification form.  It must include the Kentucky Court name and full case number for which the request is being made. Note: The Kentucky Bar Association does not authorize out of state attorneys for Federal Cases.
2. Submit the form online with a debit or credit card with the per case/per attorney fee of $310 plus an administrative processing fee of $7.75 to the Membership Department at the Kentucky Bar Association. 
3. Starting January 1, 2016, an attorney seeking certification will be assigned a permanent Pro Hac Vice ID number that is emailed from the KBA.  Thereafter, for each Pro Hac Vice Certification form submission, the attorney will be required to provide his/her permanent Pro Hac Vice ID number.  
4. A letter/receipt which certifies that the request was made and the fee was received by the KBA will be emailed. If the letter/receipt needs to be emailed to a different address, please enclose special instructions. If no special instructions are received, the letter/receipt will be emailed to the attorney seeking the certification.
5. It is the responsibility of both the Kentucky co-counsel and the attorney seeking certification to provide the letter/receipt to the court.
6. When your appearance has formally concluded in your case, notify the KBA by updating your case information listed on your dashboard.
