Reinstatement and Restoration

General Instructions

On this page you will find information and forms for applying for Restoration and/or Reinstatement following a withdrawal or suspension. The Rules cited below are effective for applications filed on or after April 1, 2022.

The forms linked on this page are fillable online, however, completed forms must be printed and mailed to the KBA. The only form accepted electronically is the Request for Certification.

Applicants must provide complete and candid information. It is your responsibility to read the rules, checklists, and forms that apply to your application carefully.

Inquiry Commission Regulation XI (ICR XI) specifies the process in reinstatements and restorations before the Inquiry Commission. ICR XI also lists the costs and fees that are required to accompany an application for reinstatement or restoration. Note that a $150 Fee and the Request for Certification must be filed before you can receive certifications from the CLE Department, Office of Bar Counsel, and Accounting/Membership, which are required items to accompany your application.

STEP 1

Submit Request for Certification Form and Pay $150 Fee (includes $50 certification fees for Accounting/Membership, Continuing Legal Education, and Office of Bar Counsel)

*You will receive a certification memo from each department notifying you of certification or further instructions.

STEP 2

Determine if you are requesting a RESTORATION or REINSTATEMENT of your license

  • RESTORATION: If an attorney is suspended for non-payment of dues and/or CLE noncompliance or has withdrawn from membership pursuant to SCR 3.480(1), the former member may seek Restoration of his or her license pursuant to SCR 3.504.
  • REINSTATEMENT: If an attorney is suspended for disciplinary reasons, the suspended attorney may seek Reinstatement of the attorney’s license. There are two processes for reinstatement, depending upon how long the disciplinary suspension has prevailed:
    • For suspensions that have prevailed 180 days or fewer, an attorney may seek reinstatement pursuant to SCR 3.501 by filing an Affidavit of Compliance.
    • For suspensions that have prevailed 181 days or more, an attorney may seek reinstatement pursuant to SCR 3.502 and SCR 3.503.
