Kentucky Court of Appeals to Implement New Prehearing Conference Protocol

Effective June 1, 2020, the Kentucky Court of Appeals will implement a new prehearing conference protocol requiring parties represented by counsel who desire a prehearing conference to file a motion requesting same, and to attach it to their prehearing statement. The form has been revised to reflect this change (AOC Form 070). Either party may file an objection to the motion within 10 days.  If no objection is filed, a prehearing conference will be granted.  Prehearing conferences will not be held in cases involving pro se litigants.  However, in all cases in which a prehearing statement is filed, the Court will review the case and enter the order required by CR 76.03(3) to start the running of time for further steps in the appeal.  On or after June 1, 2020, please refer to the appellate practice handbook for further guidance. A fillable form will post on the KCOJ website on June 1, 2020.  If an incorrect version of the form is submitted after June 1, 2020, the Clerk of the Court of Appeals will return the form with a deficiency notice.
